The South Dakota Unified Judicial System serves a population of more than 750,000 people through a system of circuit and magistrate courts, topped by a state supreme court that is the state’s court of last resort. 

South Dakota Supreme Court

The South Dakota Supreme Court consists of a chief justice, presently David E. Gilbertson, and four associates who are appointed by the governor from five appointment districts within the state. Justices are retained or removed from office by a nonpartisan ballot in the general election three years after their appointment. The chief justice is chosen by the judges themselves from within their own ranks, and serves as the administrative head of the Unified Judicial System.

As South Dakota’s court of last resort, the Supreme Court’s primary function is that of an appeals court. The court receives appeals from the Circuit Court level and determines whether the prior court’s decision was correct in law. Occasionally, the Supreme Court can issue original or remedial writs and advise the governor on issues concerning the execution of that office’s executive powers. 

Beyond its judicial functions, the South Dakota Supreme Court administers the state’s unified court system. The court prepares and submits an annual budget for the entire judicial structure of the state. It appoints court personnel. The Supreme Court also is responsible for making the rules covering the practice and procedure of courtrooms in the state, administration of the courts, terms of the courts, admissions to the bar, and discipline of attorneys and judges.

South Dakota Circuit Courts

South Dakota’s 66 counties are divided into seven judicial circuits. There are 38 judges in Circuit Court. Judges are elected on nonpartisan ballots to serve eight-year terms. The governor appoints replacement judges as needed, and the Supreme Court appoints one judge from each circuit to act as presiding judge, the person who supervises and administers operations within the circuit.

The circuit courts are South Dakota’s general trial courts. They have original jurisdiction in all civil and criminal matters. They are the only court where a criminal felony can be tried, and also the only venue where a civil case worth more than $10,000 can be heard at trial. Circuit courts also have appellate jurisdiction over appeals rising from Magistrate Court.

South Dakota Magistrate Court

The lowest tier of the judicial system in South Dakota is Magistrate Court. Thee venues are presided over by lay magistrates or by magistrate judges. A magistrate judge must be a licensed attorney, while lay magistrates need only be high school graduates.

Magistrate courts primarily assist the Circuit Court in their region by processing minor criminal cases and less serious civil matters. Whether presided over by a lay magistrate or a magistrate judge, the magistrate courts can perform marriages, receive dispositions, accept pleas for Class 2 misdemeanors and hear non-contested civil and small claims actions where the amount of money or damages sought does not exceed $8,000.

South Dakota’s magistrate courts that are presided over by a magistrate judge, rather than a lay magistrate, can also share additional authority with the local Circuit Court. Courts led by magistrate judges can conduct a preliminary hearing in a criminal case, act as a “committing magistrate” for all purposes, and conduct misdemeanor trials.

Magistrate judges may also decide temporary protection orders, try civil cases in which the claim is $10,000 or less, and try small claims cases not exceeding $8,000.
